Terms of Service

1. Who May Use the Service

The Service is intended for adults age 18 or older — including parents, guardians, teachers, daycare providers, and other authorized caregivers. Children may not create accounts or upload photos directly. If you use the Service on behalf of an organization (such as a daycare or school), you represent that you are authorized to bind that organization, and the Daycare / School Addendum also applies.

2. Your Account

You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity under your account. Notify us immediately at hello@crayonsnap.com if you suspect unauthorized access.

3. Upload Rights & Permissions

By uploading any photo, you represent and warrant that:

• You own the photo or have all necessary rights to upload it;
• You have permission from any individual recognizable in the photo, and from the parent or legal guardian of any child shown — including every visible child in group photos;
• The photo does not infringe any third-party intellectual property, privacy, or publicity right;
• The photo does not depict prohibited content (see Section 5).

You retain ownership of your photos and your generated coloring pages. You grant us a limited, worldwide, royalty-free license solely to host, process, transmit, and display your content as needed to operate and deliver the Service to you. This license ends when you delete the content or close your account, except for residual copies in encrypted backups for a short rolling window.

4. AI Processing & No Training

We send your photo to a third-party image AI (Google Gemini) solely to generate a coloring page. We do not use your uploads or generated outputs to train, fine-tune, or evaluate AI models — ours or anyone else's — unless you give separate, explicit, opt-in consent. Outputs are produced by an AI model and may contain inaccuracies; you are responsible for reviewing them before printing or sharing.

5. Prohibited Content & Conduct

You may not upload, generate, or share content that:

• Depicts nudity, sexual conduct, or sexualized depictions of any person;
• Depicts a child in any sexual, suggestive, or exploitative context;
• Is violent, gory, hateful, harassing, or promotes self-harm;
• Infringes copyright, trademark, privacy, or publicity rights;
• Contains the image of a person uploaded without their (or their guardian's) permission;
• Is illegal, deceptive, or designed to harm others or our systems.

We may remove content, suspend or terminate accounts, and report illegal content to law enforcement at our discretion.

6. Marketing Use of Your Content

We will not use your photos or generated coloring pages in marketing, social posts, advertising, public examples, or testimonials without your separate, opt-in written permission.

7. Plans, Pricing & Page Limits

CrayonSnap currently offers the following plans (prices in USD, exclusive of any applicable tax calculated at checkout):

• Free — 1 coloring page, no credit card required.
• Monthly — $4.99 per month, fair-use cap of 50 pages per month.
• Annual — $44.99 per year, fair-use cap of 600 pages per year.
• Pro / Daycare — $14.99 per month, unlimited pages, bulk PDF booklet exports, priority processing.

Page allowances reset at the start of each billing period and do not roll over. We may change pricing or plan features going forward; existing subscribers will be notified before any price increase affects their renewal.

8. Billing, Auto-Renewal & Cancellation

• Auto-renewal. Paid plans renew automatically at the then-current price (monthly or annual, depending on your plan) until you cancel.
• How to cancel. Cancel anytime in seconds from your account billing page (Stripe Customer Portal). No phone calls or emails required.
• Effect of cancellation. You keep access through the end of the current paid period; your plan will not renew. Your gallery remains available subject to the retention rules in our Privacy Policy.
• Tax. Sales tax / VAT is calculated by Stripe Tax at checkout based on your location.

9. Refunds

Because the Service delivers digital content immediately, all charges are generally non-refundable. However, if you believe you were billed in error or are unhappy with the Service, email hello@crayonsnap.com within 14 days of the charge and we will review your request in good faith. Annual subscribers may request a prorated refund within 14 days of the initial purchase if usage has been minimal.

10. Our Intellectual Property

The CrayonSnap name, logo, website, software, and content (excluding your uploads and your generated coloring pages) are owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal or internal organizational use in accordance with these Terms.

11. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access if you violate these Terms, abuse the Service, or create risk for us or other users. Sections that by their nature should survive termination (such as upload representations, indemnity, and limitation of liability) will continue to apply.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated outputs will meet your expectations.

13. Limitation of Liability

To the fullest extent permitted by law, CrayonSnap and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amounts you paid us in the 12 months before the claim, or (b) USD $100.

14. Indemnity

You agree to indemnify and hold harmless CrayonSnap and its affiliates from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your uploads, your use of the Service, or your breach of these Terms — including claims that you lacked permission to upload a photo of any person depicted.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Massachusetts for any dispute not subject to small-claims jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date above and, where appropriate, by email. Continued use of the Service after the update means you accept the revised Terms.
